By creating an account and using the Experience Portal system, you (hereinafter referred to as "Host" or "User") expressly agree to the following terms established by Netcraw creative it (CNPJ 24.473.983/0001-41), contactable via airbnb@netcraw.com or (11) 950294700.
1.1. The system is provided under the "Software as a Service" (SaaS) model. The Host will receive a free 30-day trial period ("Trial") focused exclusively on the use of the Guest Portal and essential management tools.
1.2. During the Trial period, the "Direct Online Bookings" feature will be expressly disabled, as the Trial does not constitute full commercial use of the platform as a booking engine.
1.3. At the end of the 30-day Trial, if the Host does not subscribe to an applicable paid plan, the Guest Portal will go offline and become inaccessible to the general public (your guests). The Host will retain access to the Admin Panel exclusively for data management or potential plan upgrades.
2.1. The system and its services are provided on an "as is" and "as available" basis, without express or implied warranties of uninterrupted availability or error-free operation.
2.2. The Host expressly acknowledges, declares, and agrees that Netcraw creative it and its partner developers SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR LOSS OF PROFITS, loss of revenue, loss of bookings, consequential damages, loss of data, or any indirect damages resulting from any failures, server unavailability, software bugs, cyber attacks, accidental data deletion, or discontinuity of service. The financial and operational risk of using the platform to manage their properties and guests is fully assumed by the Host.
3.1. The Host acts as the Data Controller of their guests' data, being the one who decides to collect and insert such data into the system. Netcraw acts solely and exclusively as a Data Processor of the data stored on the cloud platform.
3.2. The Host represents and warrants that they have a legal basis (such as the explicit consent of the data subject or for compliance with legal/contractual obligations) to collect, insert, store, and process sensitive and personal data of their guests (such as CPF, ID, or passport numbers) in the Experience Portal system.
3.3. Netcraw undertakes to adopt commercially reasonable information security measures to protect data stored on its servers. However, the Host fully releases Netcraw from liability for leaks resulting from misuse of access credentials by the Host, compromised Host devices, or unpredictable cyber vulnerabilities outside the reasonable control of standard market infrastructure.
3.4. As the Data Controller, the Host must directly respond to and address any requests for data deletion, access, anonymization, or portability made by their guests (the Data Subjects) based on the General Data Protection Law (LGPD) or GDPR. Netcraw will provide the Host with the tools in the panel to comply with such requests.
4.1. Netcraw reserves the right to modify these Terms of Use at any time, and it is the Host's responsibility to check them periodically. Continued use of the system after changes constitutes acceptance of the new terms.
4.2. These terms are governed by the laws of the Federative Republic of Brazil, and the court of the municipality of Netcraw's headquarters is chosen to resolve any disputes.
